TERMS AND CONDITIONS OF SERVICE

1. About ECUFlow

ECUFlow provides remote ECU calibration and digital tuning file services. Each calibration may be prepared according to the original ECU file, vehicle information and modifications requested by the customer.

By purchasing a service from ECUFlow, the customer agrees to these Terms and Conditions, the Returns and Refunds Policy and any other policies displayed on the website.

2. Nature of the service

ECUFlow supplies digital services and digital calibration files. No physical product is supplied unless expressly stated otherwise.

The customer is responsible for providing the correct original ECU file and accurate information regarding the vehicle, ECU, engine, transmission, installed hardware and requested modifications.

ECUFlow may request additional technical information before starting or completing a calibration.

3. Vehicle condition

ECUFlow performs its services remotely and does not physically inspect the vehicle.

ECUFlow therefore cannot verify the actual condition of the engine, turbocharger, fuel system, injectors, cooling system, intake system, exhaust system, sensors, actuators, clutch, gearbox, drivetrain or any other mechanical or electronic component.

The customer is responsible for ensuring that the vehicle is mechanically sound, correctly maintained and suitable for the requested calibration before installing or using the supplied file.

The customer acknowledges that increased power, torque, boost pressure, fuel delivery or other modified operating parameters may increase mechanical and thermal stress and may accelerate wear or expose pre-existing faults.

4. Performance expectations

ECUFlow does not guarantee a specific power, torque, acceleration, fuel-consumption or drivability result unless such result has been expressly confirmed in writing for the specific vehicle and configuration.

If a vehicle does not perform as expected after installation of the calibration, this does not automatically mean that the supplied ECU file is defective.

Reduced, inconsistent or abnormal performance may result from pre-existing or developing mechanical, electrical or electronic faults.

A calibration file is not a substitute for mechanical diagnosis, repair or maintenance.

5. Installation and ECU programming

The customer is responsible for correctly reading, writing and installing ECU files using suitable equipment, a stable electrical supply and the correct procedure for the relevant control unit.

ECUFlow is not responsible, to the extent permitted by applicable law, for damage resulting from incorrect programming procedures, interrupted flashing, low battery voltage, unsuitable tools, corrupted or incorrect original files, incorrect vehicle identification or other circumstances outside ECUFlow's control.

6. Motorsport and non-public-road use

Certain ECUFlow services and calibration options may be intended exclusively for motorsport, competition, track, test-bench, off-road or other non-public-road applications.

Unless expressly confirmed otherwise in writing, ECUFlow does not represent or guarantee that a modified calibration is homologated, emissions-compliant or legally permitted for use on public roads.

The customer is solely responsible for verifying that the vehicle, modifications and intended use comply with all applicable laws, homologation requirements, emissions regulations, registration requirements and insurance conditions in the jurisdiction where the vehicle is operated.

7. Customer responsibility

The customer assumes responsibility for the installation and use of the supplied calibration and for determining whether the vehicle is mechanically and legally suitable for the requested modifications.

The customer must discontinue use of the vehicle and seek appropriate technical assistance if abnormal noises, excessive smoke, overheating, abnormal boost pressure, warning lights, drivetrain problems or other potentially damaging symptoms occur.

8. Technical support

ECUFlow provides reasonable technical support both before and after purchase.

Before purchase, customers may contact ECUFlow for assistance regarding the appropriate service or information required for their vehicle.

After delivery, ECUFlow may assist with issues relating to the supplied calibration and may request diagnostic trouble codes, datalogs, ECU identification data, the original file or other technical information.

If an issue is attributable to the calibration supplied by ECUFlow, reasonable efforts will be made to correct or revise the file.

Technical support does not constitute a physical mechanical inspection of the vehicle and does not transfer responsibility for pre-existing or unrelated faults to ECUFlow.

9. Intellectual property and permitted use

ECUFlow calibration files are supplied for use in connection with the specific vehicle, ECU or order for which they were prepared.

Unless ECUFlow gives prior written permission, customers may not resell, redistribute, publicly share, commercially reproduce or supply ECUFlow calibration files to third parties.

10. Orders and payment

ECUFlow may refuse or cancel an order where the requested service cannot reasonably be performed, where the information supplied is insufficient or incorrect, or where the requested work would be inappropriate for the identified ECU or vehicle.

Payment must be completed using one of the payment methods offered at checkout.

11. Delivery

Digital files are delivered electronically using the method indicated during the ordering process, which may include email, customer account or another digital delivery method.

Processing time may depend on the ECU, vehicle, requested modifications and availability of all necessary technical information.

12. Returns, cancellations and non-conforming files

Returns, cancellations and refunds are governed by ECUFlow's Returns, Cancellations and Refunds Policy.

Nothing in these Terms affects statutory consumer rights that cannot legally be excluded or restricted.

13. Limitation of liability

To the maximum extent permitted by applicable law, ECUFlow shall not be responsible for losses or damage resulting from pre-existing vehicle faults, inadequate maintenance, incorrect installation or programming, improper use, motorsport use, non-compliant road use, incorrect information supplied by the customer or circumstances outside ECUFlow's reasonable control.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

14. Changes to these Terms

ECUFlow may update these Terms and Conditions when necessary. The version applicable to an order is the version made available to the customer at the time the order is placed.
